The Legal Stuff!

This page (together with the documents referred to on it) tells you the terms and conditions on which we supply any of the products listed on our website www.thepatchworkcat.co.uk to you. Please read these terms and conditions carefully before ordering as, by ordering any of our products, you agree to be bound by these terms and conditions.

You should print a copy of these terms and conditions for your records.

How the contract is formed between you and us

After placing an order, you will receive an e-mail from us acknowledging that we have received your order, and we will begin to put your order together.

Written communications

Applicable laws require that some of the information or communications we send to you should be in writing. When using our web site, you must accept that all written communication with us will be electronic and that the emails sent to you or the posts on our noticeboard comply with any legal requirements necessary. This condition does not affect your statutory rights.

Personal Information

In order for us to process your order and to provide the best level of service, it is necessary for us to collect and store a certain amount of personal information including your name and address, and email and telephone contact details.

We will never collect sensitive information about you without your consent.

We do not store credit card details nor do we share customer details with any third parties

We do not sell or give information to third parties, and the only communications you will receive from us will be information relating directly to your orders or our newsletter which you can opt out of at any time.

Price and payment

All prices are in pounds sterling..

Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you an Order Confirmation. Our site contains a large number of products and it is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that, where a product’s correct price is less than our stated price, we will charge the lower amount when dispatching the product to you. If a product’s correct price is higher than the price stated on our site we will normally, at our discretion, either contact you for instructions before dispatching the product, or reject your order and notify you of such rejection. We are under no obligation to provide the product to you at the incorrect (lower) price, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing.

Financial Information

We do not store any information relating to your bank account, credit or debit card or Paypal account. When you make a payment it is processed on our behalf by Paypal. We do not store any card details from any transaction. Our ecommerce site is PCI DSS compliant, therefore giving you assurance that your personal details are kept safe.

Delivery information

Any time or date stated for delivery is an estimate only. We make every effort to dispatch goods on time, but we do not accept liability for failure to deliver within the stated time.

If we are unable to deliver the goods within 30 days of the date of the order, you will be entitled to cancel the order and request that any monies paid to The Patchwork Cat Limited in respect of that order to be refunded. In order to cancel, you must send written notice of cancellation to us at The Patchwork Cat within 30 days of the order being placed but before delivery of the goods or notification from The Patchwork Cat that the goods are ready for delivery.

We do not accept liability for shortages or damage to deliveries unless you notify us of the shortage or damage in writing within 7 days of receipt of the delivery.
You as the customer have to accept the goods when they are ready for delivery.

Delivery is deemed to have taken place when the goods are delivered to your nominated address, whereupon the risks of loss, breakage and all damage and all other risks shall pass to you.

Title of the goods does not pass to you until payment is received in full by The Patchwork Cat.

You may request a Proof of Delivery, provided that this request is made in writing within 1 month of the date of delivery and we shall use reasonable endeavours to provide such proof. Thereafter, delivery shall be deemed to have been successfully completed.

Import Duty

If you order products from our site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.

Refunds

If you change your mind over an order you have received, we respectfully request that you notify us in writing within 14 days before sending the goods back. If packaged by the manufacturer we would expect the packaging to be intact, and the goods inside complete. Upon receipt to our office and after inspection, a refund less any postage costs will be arranged. If paid by card, this may take 3-4 days to show on your card account.
Any fabrics cut to your specification, or special order items cannot be returned or refunded.
You are responsible for paying the return postage unless there is blame on our part.

Please make sure that you enclose in your return, a note of your name, address, purchase date and order number. Items must be returned in their original condition. Obtain a proof of postage from the post office as we are unable to accept responsibility for parcels lost in transit.

Colours

We use a combination of manufacturer’s stock photography and our own photographs. Although we have taken care to use natural day light for our photographs the colours may vary slightly from computer to computer. Dye lots may also mean slight changes of colour should you make repeat purchases of any of our products. If you have any questions regarding this, please do not hesitate to ask.

Our right to amend these Terms and Conditions

We have the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities.

You will be subject to the policies and terms and conditions in force at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Dispatch Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the Products).

Whilst we endeavour to keep the information and products on this website up-to-date and correct, we make no warranties about the accuracy, reliability, suitability or availability of information and products on this website. All items are for decorative purposes only and should not be treated as toys. Therefore products should not be given to babies or children.
Every effort is made to keep the website up and running smoothly. However, we take no responsibility for, and will not be liable for, the website being temporarily unavailable due to technical issues beyond our control.

Through this website you are able to link to other websites which are not under the control of The Patchwork Cat. We have no control over the nature, content and availability of those sites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.

Law and Jurisdiction

Contracts for the purchase of products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such contracts or their formation (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

Intellectual property rights

The Patchwork Cat is the owner of all intellectual property rights contained in the site.

You may not, except with our express written permission, distribute or commercially exploit the content. Nor may you transmit it or store it in any other website or other form of electronic retrieval system.
